NO ASSIGNMENT BY BUYER OR GUEST: This contract and the rights of membership are not assignable by the buyer or guest.
WARRANTY OF GUESTS FITNESS: Buyer and guest warrant that guest is in good physical condition and that he/she has no disability,
impairment or ailment preventing him/her from engaging in active or passive exercise or that will be harmful to his/her health,
safety, comfort, or physical condition if he/she does engage or participate in activities.
ENTIRE AGREEMENT: This Contract constitutes the entire and exclusive agreement between the parties. Any promises, representation,
understanding or agreement pertaining directly or indirectly to this Contract which are not contained herein, are hereby waived.
LIMITATION OF LIABILITY: Guest shall participate in physical conditioning and/or use the gym's facilities, services or
equipment at his/her own risk.
VALUABLES AND PERSONAL PROPERTY: Guests are urged to avoid bringing valuables onto the gym premises.
The Body Reserve, its affiliates, agents or employees shall not be liable for the loss, theft of, or damage to, the personal
property of guest or unless deposited with the manager or assistant manager with a written receipt. Managers and assistant
managers are authorized to accept such property solely for the benefit of guest. In no instance shall the gym's liability
exceed $100.00.
RULES AND REGULATIONS: Guest agrees to abide by and obey all the rules and regulations reasonably established by The Body
Reserve or its agents for the best interest of the guest, whether posted or communicated orally, including but not limited
to behaving so as not to disturb, annoy, or endanger others. The Body Reserve reserves the right to revoke privileges for
infractions or violations by guest of rules and regulations or the terms of this contract. Upon such revocation, no part of
the fee shall be refunded and any unpaid portion thereof shall become immediately due and payable.
LOCKERS: Lockers are provided solely for the benefit and convenience of guest. Guest is urged to place his/her own lock
on locker for protection of his.her property during guest's visit to the gym. Management reserves the right to clip any lock
left on a locker overnight.
BUYERS INDEMNITY AGREEMENT: Buyer assumes full responsibility for any person who becomes a guest under this agreement and
shall indemnify The Body Reserve, its affiliates, agents and employees against any and all liability incurred by them to such
guest who does not become a signatory.
